—There’s a fourth investigation involving East Bay MUD Board Director April Chan, but this one was initiated by Chan against Board President Marguerite Young.
Chan filed the complaint against Young last month, alleging the investigations that followed a dispute over a boardmember’s parking space on March 27 was motivated by Young’s “anti-Asian bias.”
In addition, the investigations are retaliation by Young against Chan for publicly accusing East Bay MUD of mismanaging $279 million in district funds.
Chan’s opposition to the district’s plan to import soil to an area in her ward, also amounted to retaliation, she wrote in the complaint..
Chan made the same allegations at a board meeting on May 13, adding, “The things that I have done is what’s causing you to retaliate against me,” Chan told Young.
“The above actions were intended to humiliate, marginalize and disrespect me in front of the public and my fellow Board members,” Chan wrote in the complaint, filed on May 22.
In addition, Chan wrote, the independent investigation into the March 27 incident is tainted because Young distributed Conway’s initial statement to members of the district prior to an investigation being authorized.
OTHER EBMUD INVESTIGATIONS
A complaint was filed by an artist named Tiffany Conway against Chan in March that accused the board director of racial-motivated misconduct during a dispute preceded by a misunderstanding over a boardmember’s parking space. The independent investigation remains pending.
In addition, a report issued by East Bay MUD’s security department was released to the public earlier this month and found that Conway’s conduct, not Chan’s, raised to the level of violating East Bay MUD’s workplace conduct rules.
Yet another report, also believed to focus on Chan, but not directly related to the March 27 incident, remains pending.
